Important legal advice and disclaimer
Any rental period is only a seasonal lease agreement between two parties; the owner and the tenant. It is a Tourist letting contract under the general tenancy law of Spain, “Ley 39/2017” (TOURIST LICENCE NUMBER ETVPL/13692)
1 Travel Insurance
It is advisable for the renter to hold suitable cancellation insurance, and for this insurance to be in place at the time the booking is made.
2 Liabilities
The owners do not accept any responsibility or liability for acts of omission of third parties which may prevent or disrupt a tenant’s booking. The contract exists between the owner and the tenant and is limited to the rental of the property only. The information and descriptions supplied are believed to be accurate and are offered in good faith. No liability can be accepted by the owners for any injury, loss or damage to the tenant, any member of the tenant’s party or any visitor to the apartment arising out of or in connection with the use of the rental home or the pool. The tenant must ensure that children are supervised at all times. Both parties agree that this contract is made under the laws and jurisdiction of Spain. All parties must also abide by the community rules which are attached in another document.
3 Tourist services
This Seasonal Rental Contract is subject to the provisions of the Tenancy Act. The renter accepts the rental premises as they are, to use as they see fit. The contract is only for the rental of the apartment, and no touristic services are provided, offered, or implied. The rental does NOT include the following services: housekeeping, catering or cooking, babysitting, passenger transport although we can offer advice and contacts on these things.
4 Force Majeure
No liability can be accepted by the owners where the contract is affected by ‘force majeure’. In the context of these terms and conditions, this is any event that the owners could not, even with due care, foresee or avoid. These events include but are not limited to; war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, burglary, acts of God, terrorist activity, nuclear disaster, adverse weather, government action, problems with transportation or other events outside the owners’ control.
5 Payment Details
25% DEPOSIT REQUIRED WITHIN 5 DAYS OF ENQUIRY
FINAL AMOUNT (PLUS AN ADDITIONAL £200 AS A REFUNDABLE SECURITY DEPOSIT)
A comprehensive apartment info pack will be emailed once the full balance has been received.
6 Cancellations
A 70 day notice (10 weeks) is required for cancellation. This is when the final payment is due. This will incur a loss of the 25% deposit but no further charge. If possible we will try to accommodate you with another available booking during the same season if we resell your booking period first. If we manage to resell it, we will refund the deposit minus an admin cost of £25 .
7 Apartment Rules
It is a no smoking apartment. No pets allowed. No single sex groups if all guests are 25 or under. Only whole week bookings from Saturday to Saturday in the high season-end of June to end of August.
Our Apartment is in a gated residential community. It does not have the facilities of an ‘aparthotel’, such as reception desk, lifeguards, pool fencing, poolside toilet; security guard.
Renters must read and comply with the Community Rules, (sent with the final information booklet) so as to cause no disturbance to other residents.
8 Rates and Tourist Tax
NB – Rates are subject to change until the reservation is confirmed.
All legal rentals in Mallorca must collect a “Tourist tax” of €2 per person per night, aged 16 and over. It is to be paid when the final payment is due 10 weeks before your holiday commences.
Also legally required is a scan of the passport of every traveller. These must be emailed to us in advance so that we can send them on to the Guardia Civil. We are very sorry to have to impose this cost and bureaucracy, but we have no choice. Hotels and hostels have the same procedures too.
Any rental of 30 days or more will constitute a Seasonal residential Lease, as foreseen in article 3.2 of Act 29/1994 on Spanish Urban Tenancy of a house (in Spanish ‘Ley de Arrendamientos Urbanos’). No tourist tax is chargeable for 30 days and more.
